The petitioner apprehends his arrest in connection with Karakat P.S. Case No. 210 of 2017, registered for the offences punishable under Sections 341, 323, 324, 504, 379 and 34 of the Indian Penal Code.
Allegedly, the petitioner and other co-accused after dragging the informant from tempo assaulted him with lathi, danda and the petitioner took out purse containing cash of Rs. 1300/-, mobile and Adhar Card.
Submission is of false implication and that there is case and counter case, Chitranjan Kumar has lodged Karakat P.S. Case No. 209 of 2017 and thereafter this case has been filed
Patna High Court Cr.Misc. No.63351 of 2017(2) dt.05-02-2018 2/2 with wrong allegation. There is no injury to the informant and the allegation under Section 379 I.P.C. is super addition and, as such, the petitioner deserves sympathetic consideration. The learned A.P.P. fairly submits that the case lodged by the Chitranjan Kumar is of earlier.
In the facts and circumstances as stated above, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Bikramganj, in connection with Karakat P.S. Case No. 210 of 2017, subject to the conditions as laid down in section 438(2) of the Cr.P.C.
