The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Barauni Zero Mile P.S. Case no. 114 of 2017 instituted for the offence under Sections 379 and 420 of the Indian Penal Code.
As per allegation in the FIR, a call from the petitioner's mobile was made to the informant and accused person asked the informant to provide 16 digit imprinted number of the ATM Card and fraudulently accused has withdrawn an amount of Rs. 75,000 from the account of the informant.
Learned counsel appearing on behalf of the petitioner
Patna High Court CR. MISC. No.69266 of 2021(3) dt.20-07-2022 2/2 has submitted that petitioner is innocent and has committed no offence. He is an illiterate person. Some other person has taken SIM Card by using the Adhar Card. Petitioner has no concern with the alleged mobile number.
Learned APP appearing for the State has opposed the prayer of Bail.
Having heard learned counsel for the parties and taking into consideration that there is ample material against the petitioner against the petitioner, I am not inclined to grant bail to the petitioner and, as such, his application for bail is rejected. (Sunil Kumar Panwar, J) sushma/- U
