2. The petitioner is apprehending his arrest in connection with Complaint Case No. 564 of 2022 for the offence under Sections 498A of the I.P.C. and Sections 3/4 of the Dowry Prohibition Act.
3. As per the prosecution story, the complainant has alleged that her marriage was solemnised with the petitioner on 26.04.2021 according to Hindu rites. After the marriage, the family members of the petitioner started demanding L.C.D. TV and due to non-fulfillment of the same she was tortured by her in-laws and consequently they ousted the complainant from their house.

4. Learned counsel for the petitioner submits that the petitioner is quite innocent and has been falsely implicated in the present case. The petitioner is ready to keep his wife and his minor son with full honour and dignity. O.P. No. 2 does not want to live with the petitioner for the reasons best known to her. There are general and omnibus allegations have been levelled against the petitioner. Neither petitioner nor any member of his family has done any cruelty or harassment on the opposite party no. 2 and never made demand of any articles or dowry.
5. Learned APP opposes the prayer for bail.

During the course of argument, learned counsel for the petitioner submits that there are general and omnibus allegations against the petitioner and he is still ready to keep his wife and minor child with full honour, dignity and affection. From perusal of S.A. of the complaint petition, it appears that complainant has stated before the Court that even her husband is ready to keep her with full honour and dignity, she will not go with him. Keeping in view the aforesaid facts, this Court is inclined to extend him the privilege of anticipatory bail.
7. Let the petitioner be released on bail in the event of arrest or surrender within a period of four weeks from the

No.61186 of 2023(4) dt.28-03-2025 3/3 receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, West Muzaffarpur, in connection with Complaint Case No. 564 of 2022 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
