JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 02-12-2022 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. The petitioner apprehends his arrest in a case registered for the offence punishable under Section 30(d) of the Bihar Prohibition and Excise Act.

4000 litre semi prepared Mahua solution has been recovered from the spot. The petitioner and other co-accused persons are said to have fled away from the spot after seeing the police. It is alleged that the petitioner is a member of the syndicate involved in manufacturing and selling of illicit liquor. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. It is submitted that the petitioner has got no

Patna High Court CR. MISC. No.58660 of 2022(2) dt.02-12-2022 2/2 criminal antecedent as stated in paragraph-3 of the bail application. It is further submitted that there is no recovery from the conscious possession of the petitioner and local Chowkidar has disclosed the name of the petitioner.

Learned APP for the State submits that the petitioner is a member of the syndicate involved in manufacturing and selling of illicit liquor.

Considering the fact that petitioner is a member of the syndicate involved in manufacturing and selling of illicit liquor, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected in connection with Warisaliganj P.S. Case No.103 of 2022, pending in the court of learned Exclusive Special Excise Judge, 2nd, Nawada.
