JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 22-03-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Ballia P.S. Case No. 139 of 2021 registered for offence punishable under section 392 of the Indian Penal Code against unknown in which section 411 of the Indian Penal Code was added.

As per allegation, the informant was going with her Debar Priyanshu to Saadipur Diara. When they reached near Karadhi Bandh, two unknown persons came there. They had covered their faces by wrapping Gamcha and at the point of pistol, they snatched purse from her possession. The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.57667 of 2022(4) dt.22-03-2023 2/3 that except confessional statement of co-accused Rupesh Kumar Paswan, there is nothing against the petitioner. Rupesh Kumar Paswan has been granted bail by the coordinate Bench of this Court.

On the other hand, the learned APP has opposed the prayer for bail.

It appears that the petitioner's name has figured in the confessional statement of co-accused Rupesh Kumar Paswan, who has been granted bail by a coordinate Bench of this Court. As per direction of this Court, the petitioner was put on TIP, but the informant did not identify him and has stated that it was not possible for her to identify the miscreants as they had covered their faces. The petitioner is under custody since 21.06.2021. Considering the above-mentioned facts and circumstances as well as the period of custody, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Ballia P.S. Case No.139 of 2021, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
