JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-03-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 302 of the Indian Penal Code. The trial court has reported that nine prosecution witnesses have already been examined and only three charge sheeted witnesses including investigating officer of the case have been left to be examined. The trial court has reported the reason of delay in conclusion of the trial of the petitioner. Moreover, petitioner happens to be main assailant and, therefore, again, I am not inclined to release the petitioner on bail. Hence, his prayer for bail in connection with Sessions Trial No. 106 of 2015 arising out of Brahampur P.S. Case No. 65 of 2015 pending in the court of Additional Sessions Judge-V, Buxar
Patna High Court Cr.Misc. No.3337 of 2017 (3) dt.15-03-2017 2/2 stands rejected.
However, learned trial court must conclude the trial of the petitioner within three months from the date of receipt/production of copy of this order, failing which the petitioner may renew his prayer for bail before this Court. Let a copy of this order be sent to Superintendent of Police, Buxar with direction to him to ensure the presence of remaining prosecution witnesses of aforesaid case before the trial court without any delay.
