Petitioner seeks regular bail in connection with Hajipur Sadar PS Case No. 710/2021 registered for the offence punishable under Sections 414, 399 and 402 of the IPC and under Sections 25 (1-b)a, 26 and 35 of the Arms Act. The police personnel, on the basis of confidential information that five to six miscreants have assembled at Dighikala West, Hajipur Chhapra overbridge, in order to commit dacoity, proceeded towards the place of occurrence and upon seeing the police party, the accused persons tried to flee away. However, four accused persons were arrested while two of them managed in fleeing away. The police also recovered pistol, live cartridges, knives, motorcycle ete., from the possession of the accused persons.

No.69501 of 2021(2) dt.23-05-2022 2/2 Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case with an oblique motive. He further submits that from the FIR as well as seizure list, it would be evident that only a knife has been recovered from the possession of the petitioner. The petitioner is in custody since 08.08.2021 and the charge-sheet in the matter has already been submitted.

Regards being had to the submissions made by the parties and taking into consideration the material on record and the fact that the petitioner is in custody since 08.08.2021 and the charge-sheet in the matter has already been submitted, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, SURAJ @ BILLA be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Sadar PS Case No. 710 of 2021.
