2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 147, 148, 149, 341, 323, 324, 325, 302, 504, 506 of the Indian Penal Code.

3. As per prosecution case, the petitioner along with other FIR named accused persons are alleged to have assaulted the informant and his sisters due to which one of his sister namely, Indrasan Devi sustained injuries and died. The alleged occurrence took place in the background of political rivalry between the parties.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has

From perusal of FIR, no specific overt-act attributed to the petitioner rather general and omnibus allegation of assaulting leveled against him. The petitioner has got no criminal antecedent and languishing in judicial custody since 22.6.2023. Moreover, similarly situated co-accused namely, Rajdev Paswan has already been granted bail by this Court vide order dt. 21.6.2023 passed in Cr. Misc. No. 12252 of 2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody period of the petitioner, this court is inclined to enlarge him on bail. The above named petitioner is directed to be released on bail in connection with Bidupur P.S. Case No. 336 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur.
