JUSTICE V. NATH ORAL JUDGMENT 18-01-2016 Heard learned counsel for the petitioner as well as learned counsel for the opposite parties.
2. This revision application has been filed under Section 14(8) of the Bihar Building (Lease, Rent and Eviction) Control Act, against the judgment and order of the Court below.
3. After some arguments, learned counsel for the petitioner has stated that the petitioner is ready to vacate the suit premises within a period of six months and hand over the vacant possession of the suit premises to the opposite parties after six months.
4. A supplementary affidavit has also been filed on behalf of the petitioner on 15.01.2016, wherein, in paragraph no.
Patna High Court C.R. No.93 of 2013 (18) dt.18-01-2016 6, a statement has been made by the petitioner that the petitioner is ready to vacate the suit premises after expiry of a period of six months from today and the undertaking in that regard has been given.
5. Learned counsel for the opposite parties submit that the opposite parties have no objection to the aforesaid stand taken on behalf of the petitioner, as mentioned in the supplementary affidavit filed on 15.01.2016.
6. In view of the aforesaid facts and undertaking made in the supplementary affidavit filed by the petitioner, this revision application is disposed of with a direction to the petitioner to vacate the suit premises within a period of six months from today. The proceeding of the Execution Case No. 03 of 2013 before the Munsif 1st, Madhubani, shall remain stayed.
