ANJANA MISHRA ORAL ORDER 13-09-2019 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are in custody since 28.07.2019 in connection with Complaint Case No. C2-468 of 2019 registered for the offence under Section 30 (a) of the Bihar Prohibition & Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recoveries were made from near a pillar and not from the conscious possession of the petitioners and they were arrested only on suspicion. It is further submitted that petitioners have no criminal antecedent.

Considering the aforementioned facts and

No.57886 of 2019(2) dt.13-09-2019 2/2 circumstances and that the petitioners have clean antecedents, let the petitioners, above named, be released on bail on their furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional District & Sessions Judge- cum - Special Judge, Excise Act, Sitamarhi, in connection with Complaint Case No. C2-468 of 2019.
