The petitioner apprehends his arrest in connection with Vishwa Vidhyalaya (L.N.M.U.) P. S. Case No. 84 of 2017 registered for the offences punishable under Sections 341, 324, 307/34 of the Indian Penal Code.
The allegation against the petitioner in the FIR is that he assaulted the brother of the informant with knife with an intention to kill him on his hand and chest, resulting, the brother of the informant became unconscious and fell down. He was treated in DMCH and thereafter, at the request of the informant he was referred to PMCH, Patna.
Submission is of false implication and that the petitioner is
Patna High Court Cr.Misc. No.51094 of 2017(3) dt.14-12-2017 2/2 the husband of the informant, family dispute is going on and due to that the informant has lodged false case, opinion of the injuries have been kept reserve and as such the petitioner deserves sympathetic consideration.
Learned APP opposes the prayer of pre-arrest bail by submitting that from the injury report it reveals that on chest and hand incised wound have been found.
In the facts and circumstances stated above, considering the allegation attributed against the petitioner, this Court is not inclined to grant privilege of pre-arrest bail to the petitioner and accordingly, his such prayer stands rejected. (Jitendra Mohan Sharma, J) avin/- U T
