The petitioner apprehends arrest in a case registered for the offence punishable under sections 302/34 of the Indian Penal Code and section 27 of the Arms Act .

Prosecution case is that informant and his son had gone to attend Shradh in village Mathuri. Informant's son became traceless and next day his dead body was recovered in the ditch of village Ramdihra leading to registration of FIR against unknown.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case on suspicion. Petitioner's name has figured during course of investigation in confessional statement of co-accused Dharmdeo Yadav. No other substantive evidence has been collected during course of investigation to suggest the

Petitioner has no concern with the love affair of Sourav Raj and daughter of Nirmal Yadav which is said to be the cause of the incident. Petitioner is not even his family member. Petitioner has got no criminal antecedent.

Considering the aforesaid facts, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate 1st class, Bhojpur at Ara in Agaion G Police Station Case No. 174 of 2020, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
