2. The petitioner apprehends his arrest in connection with Muffasil P.S. Case No. 171 of 2024 registered under Section 366 of the Indian Penal Code.
3. As per F.I.R., co-accused Rajkaran Kumar also known as Fantus Kumar along with this petitioner kidnapped the daughter of informant for the purpose of marriage.
4. Learned counsel appearing on behalf of the petitioner submits that from perusal of statement of victim recorded under Section 164 Cr.P.C., it would be evident that specific allegation of kidnapping is against co-accused Rajkaran Kumar, who is already under custody. This petitioner has falsely been
Patna High Court CR. MISC. No.63171 of 2024(4) dt.08-01-2025 2/2 implicated in this case only because he happens to be father of co-accused Rajkaran Kumar. There is no specific allegation against this petitioner. Petitioner has got clean antecedent.
5. Learned A.P.P. for the State opposed the prayer for bail.
6. Having considered the facts and circumstances of the case as well as the statement of victim recorded under Section 164 Cr.P.C., let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of eight weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Nawada in connection with Muffasil P.S. Case No. 171 of 2024, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Singh, J) utkarsh/- U T
