2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 385, 387, 427 and 34 of the Indian Penal Code and Section 13 of the U.P.A Act.
3. Allegation against the petitioner along with other co-accused persons is that they pasted pamphlet on the wall of the village for demanding extortion money and created a havoc and fear in the society.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case, merely on suspicion. No any ransom or extortion demand has been executed. It is further
Patna High Court CR. MISC. No.63079 of 2023(2) dt.09-10-2023 2/2 submitted that charges have been framed in this case. Nothing consistent material has come against the petitioner in this alleged offence. Moreover, he is languishing in judicial custody since 19.01.2023.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bhagwanganj P.S. Case No. 47 of 2012 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M. Masaurhi, Patna.
