JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-11-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 143, 427, 385 and 504 of the Indian Penal Code and Section 3 (I) (X) of the SC/ST (Prevention of Atrocities) Act.
The prosecution case is that the informant was constructing boundary wall on his purchased land when accused persons including the petitioners came and demolished the wall and on protest being made by the informant, the informant was abused and assaulted by the accused persons and accused persons also snatched `22,000/- and gold chain of the informant. It is submitted by learned counsel for the petitioners that for the occurrence of 29.08.2015 the FIR was lodged on 01.09.2015 and the prior to the occurrence 107 Cr. P.C.
Patna High Court Cr.Misc. No.53079 of 2015 (2) dt.23-11-2015 2/2 proceeding was also initiated between the parties. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.
Considering the delayed lodging of the case and accusation being levelled in the background of land dispute, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Samastipur in connection with Samastipur Muffasil P.S. Case No. 263 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
