2. Petitioner seeks regular bail in a case registered under Section 30(a) of the Bihar Prohibition and Excise Act.

3. There is recovery of 47.625 litres Indian made foreign liquor and 75 litres beer from Mahindra Car. Petitioner was apprehended on the spot who was driving the vehicle.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Petitioner is not the owner of the vehicle in question. Nothing has been recovered from conscious possession of the petitioner. Petitioner has no concern with the seized liquor. Petitioner had taken the vehicle from one Gulshan Kumar for delivering some consignment but he was unaware of the illicit

Patna High Court CR. MISC. No.59845 of 2025(2) dt.17-09-2025 2/2 liquor which was kept in the locker of the vehicle. Petitioner has no criminal antecedent and he is in jail since 02.07.2025. Petitioner undertakes to cooperate in the investigation and trial.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case, the submissions of the parties and period of custody, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge (Excise) II, Nawada in connection with Excise P.S. Case No.450 of 2025.
