JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-01-2017 The petitioner is in custody since 24.10.2016 in connection with Banka P.S. Case No. 30 of 2016, registered for offences punishable under Sections 341, 307, 379, 504/34 of the Indian Penal Code and Section 27 of the Arms Act. It has been submitted on behalf of the petitioner that though there is allegation against the petitioner that he fired on the informant on his face but the injuries caused to him was found to be simple in nature. As a matter of fact that the informant is Balu Mafiya and petitioner being a local person, protested the illegal lifting of sand, for which the petitioner has been falsely implicated in the present case and he has been in judicial custody since 24.10.2016 Learned counsel for the State opposed the prayer of bail.
Patna High Court Cr.Misc. No.432 of 2017 (2) dt.31-01-2017 2/2 Having heard both sides, in view of the fact that there is direct allegation of firing against the petitioner causing injury to the informant, I am not inclined to grant the petitioner, the privilege of regular bail, it is accordingly rejected. However, the petitioner may renew his prayer for bail, once the charge is framed in this case.
