Petitioners seek regular bail in connection with Gopalganj Town PS Case No. 500 / 2021 registered for the offence under Sections 419 / 420 / 406 / 467 / 468 / 471 / 120B of the IPC.
Petitioners have allegedly executed a lease deed of a piece of land in favour of the informant for the purpose of installation of petrol pump on a monthly rental but subsequently it was found that the land stood in the name of the mother of the petitioners.
Learned counsel submits that petitioners have falsely been implicated in this case on the basis of a concocted story
Patna High Court CR. MISC. No.70045 of 2021(2) dt.24-05-2022 2/2 and the petitioner no. 2 is the son of petitioner no. 1 and the fact of the matter is that NOC issued by the district administration was subsequently cancelled on the basis of enquiry done by the oil company on the basis of objection given by the mother of the petitioners. The mother of the petitioners has been granted bail by this Court in Cr. Misc. No. 63312 / 2021. Petitioners are in custody since 10-09-2021 having no criminal antecedent.
Regard being had to the submissions made by the parties, taking into consideration the material on record, the fact that allegation made in the FIR gives rise to a civil dispute, mother of the petitioners has been granted bail by this Court and petitioners are in custody since 10-09-2021, and as such, I am inclined to grant regular bail to the petitioners. Let the petitioners, above named, be released on regular bail on furnishing bail bond of Rs. 20000/- (twenty thousand ) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Gopalganj Town PS Case No. 500 / 2021.
