This is an application for grant of anticipatory bail in connection with Phulwarisharif P.S. Case No. 532 of 2021 registered for the offences punishable under Sections 341, 323, 326, 307, 379, 34 of the Indian Penal Code.

As per FIR, there is allegation that due to land dispute in presence of petitioner co-accused persons came and shot fire upon the informant due to which he sustained injury. Learned counsel for the petitioner submits that there is no specific or direct allegation of firing against the petitioner and due to village politics and previous enmity, petitioner has been falsely implicated in this case. He further submits that other co-accused Raushan Raj @ Raushan Kumar and Aman Raj@ Aman Kumar have already been granted anticipatory bail

Patna High Court CR. MISC. No.70305 of 2021(2) dt.06-06-2022 2/2 passed in Cr. Misc. No. 68954 of 2021 vide order dated 18.05.2022 by the coordinate Bench of this Court. He further submits that petitioner has no criminal antecedent. Considering the aforesaid submissions made by the learned counsel for the petitioner, let the petitioner, abovenamed in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge SC/ST Act, Patna in connection with Phulwarisharif P.S. Case No. 532 of 2021, subject to the conditions as laid down under Section 438(2) of Code of Criminal Procedure.
