The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 148, 341, 323, 324, 307, 379, 504 and 506 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that while he was going to his village by his motorcycle and reached near the house of Kamlesh Singh, accused persons, including the petitioner, came armed with dangerous weapon and on orders of the petitioner, it is alleged that Vikash Singh tried to strangulate the informant by putting a muffler around his neck, Robin Singh assaulted with an iron rod on the head causing injury, Balveer Singh, Rajvir Singh and Kamlesh Singh
Patna High Court CR. MISC. No.69782 of 2021(3) dt.26-07-2022 2/3 assaulted the informant with lathi, hockey stick causing injury on the head and Arvind Singh snatched gold chain worth Rs. 35,000/- and the accused fled away when villagers gathered and accordingly the informant was taken to the hospital. Learned counsel for the petitioner submits that from bare perusal of the allegation as alleged in the F.I.R. it would manifest that petitioner has been falsely implicated in the case by alleging that he is an order giver, it is next submitted that no specific overt act of assault has been alleged against the petitioner. Learned counsel submits that since the informant lost the election of Mukhiya from the brother of the petitioner in 2016, as such the informant was carrying grudge and thus implicated the petitioner falsely in the present case. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the
