JUSTICE SANJAY PRIYA ORAL ORDER 08-12-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Hilsa P.S. Case No. 333 of 2017 instituted for the offence under Sections 304(B)/34 of the Indian Penal Code.

It is alleged in the written report that daughter of the informant was burnt to death by this petitioner and another accused persons as named in the Fardbeyan. It is further alleged that the daughter of the informant gave information on Mobile phone to the Jout of the informant namely, Ghanshyam Kumar that she has been set on fire by the accused person in her sasural and, thereafter, the Jout of the informant Ghanshyam reached the sasural of her daughter at Hilsa and found that the treatment of the girl (deceased) was going on. He brought the victim girl

Patna High Court Cr.Misc. No.53198 of 2017 (3) dt.08-12-2017 2/2 (deceased) to Appolo Hospital after seeing her serious condition where she died during course of treatment. It is further alleged that since the date of marriage, the accused persons used to make demand of dowry from the daughter of informant for which the daughter of the informant had given information to the informant. The statement of Ghanshyam Kumar has been recorded in paragraph 13 of the case diary wherein he has supported the case of the informant as mentioned in the written report.

Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner stands rejected.

Petitioner may surrender before the court below and make prayer for regular bail.
