JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-09-2019 This is an application for grant of anticipatory bail in connection with Dhansoi P.S. Case No. 68 of 2019, disclosing offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per F.I.R. police got an information that petitioner and other accused persons have brought huge delivery of liquor and on that information, police raided the complex of the School and petitioner and other accused persons were seeing fleeing away and identified. From the Pick-up van there is recovery of 1797.120 liters of liquor.

Submission of the learned counsel for the petitioner is that only on the basis of suspicion, he has been made accused in this case. No source of identification has been mentioned as to how the police has identified this petitioner.

Having heard both sides, in view of the facts and circumstances, as stated above, this application is disposed of with a direction to the petitioner to surrender and pray for regular bail, the same shall be considered by the learned Special Judge on the basis of the materials available on the record, especially in the background of the submissions of the petitioner that there is no source of identification and no person has been named who identify the petitioner, apart from the police party.
