JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 17-02-2017 Heard learned counsel for the petitioners and learned counsel representing the State.

The petitioner apprehends his arrest in connection with Chapra Town P.S. Case No. 350 of 2014, registered for the offences punishable under Sections 341, 323, 307, 504, 506/34 of the Indian Penal Code.

Allegedly, the petitioner and other co-accused Manu Srivastava assaulted the informant with fists and slaps whereas Bhukul Srivastava assaulted with brick on his head. Submission is of false implication and that against the petitioner no offence under Section 307 of the Indian Penal Code is made out, there is only allegation that he and co-accused have assaulted the informant with fists and slaps and, as such, the

Patna High Court Cr.Misc. No.4626 of 2017 (2) dt.17-02-2017 2/2 petitioner deserves sympathetic consideration. The learned A.P.P. fairly submits that the petitioner has assaulted with fists and slaps.

In the facts and circumstances as stated above, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra, in connection with Chapra Town P.S. Case No. 350 of 2014, subject to the conditions as laid down in section 438(2) of the Cr.P.C.
