The petitioner seeks bail in connection with Nawada Town P.S. Case No. 500 of 2015 giving rise to POCSO Case No. 24 of 2015 registered under Sections 377 of the Indian Penal Code and Sections 4,6,8 of the POCSO Act. It has been contended by the learned counsel for the petitioner that the medical report of the victim does not corroborate the allegation made in the first information report. Be that as it may, regard being had to the gravity of the offence and serious nature of allegation made against the petitioner, which has duly been corroborated by the victim and

Patna High Court Cr.Misc. No.52615 of 2015 (3) dt.30-01-2016 other witnesses during investigation of the case, I am not inclined to grant him bail.

Accordingly, the prayer for bail is rejected. The learned Special Judge, POCSO Act, Nawadah is directed to expedite the trial and conclude the same as early as possible, preferably within nine months from the date of framing of charge, failing which the petitioner would be at liberty to renew his prayer for bail in the court below itself and in that circumstance while disposing of the bail application, the court below must assign reason as to why the trial could not be completed within the stipulated period.
