JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-01-2017 The application is for grant of regular bail in connection with Dumraon P.S. Case No. 185 of 2016 registered for offences under Sections 25(1b)a, 26, 35 of the Arms Act. It has been submitted on behalf of the petitioner that there is recovery of one country made pistol and three cartridges from the petitioner and he remained in custody for seven months, as such, he be enlarged on bail. It has further been submitted that a large number of cases have been lodged against the petitioner but in many of the cases he has been acquitted and in some of the cases he is on bail.

Heard learned A.P.P. also. Learned A.P.P. has opposed the prayer for bail of the petitioner.

Having heard both sides. In view of the fact that a large

Patna High Court Cr.Misc. No.390 of 2017 (2) dt.31-01-2017 number of cases have been lodged against the petitioner, I think it proper that the trial of the petitioner be concluded. As such, I am not inclined to grant bail to the petitioner. However, the court below is directed to expedite the trial by conducting the same on day to day basis and conclude within a period of six months from the date of receipt/production of a copy of this order by the court below. In the meantime, the Superintendent of Police, Buxar is directed to produce the witnesses in connection with the aforesaid case in the court concerned on day to day basis.

With this observation, this application is dismissed with liberty to the petitioner to renew his prayer for bail if the trial is not concluded within the six months.
