JUSTICE SANJAY PRIYA ORAL ORDER 11-01-2018 Heard learned counsel for the petitioners and the State. The petitioners apprehend arrest in Kesaria P.S. Case No. 202 of 2012 instituted for the offence under Sections-302, 120(B) of the Indian Penal Code.
It is alleged in the written report that this petitioner is the husband of the deceased. He took the deceased (sister of the informant) with him to Assam after Bidagiri and thereafter, the informant got information on mobile that his sister has been done to death and dead body has been cremated.
The case diary has been received.
Counsel for the State has after perusing paragraphs-72 to 75 of the case diary submitted that it appears that processes u/Ss 82 & 83 Cr.P.C. has been issued against the petitioner and the same has also been executed by police.
Patna High Court Cr.Misc. No.52088 of 2017 (3) dt.11-01-2018 2/2 In such circumstances, this court does not find it a fit case for grant of anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail stands rejected.
The petitioner is directed to surrender in the court below and seek regular bail which will be considered and disposed of on its own merit without being prejudiced by this order and if possible, the same be disposed off on the same day.
