The petitioner apprehends his arrest in connection with Complaint Case No. 274 of 2015, registered under Sections 323, 498A & 504/34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.
The accusation is of torturing of the complainant by her husband (Petitioner) due to non-fulfillment of demand of motorcycle and computer and, thereafter, drove out from her matrimonial house. Learned counsel for the petitioner submits that due to bad behaviour of the informant, petitioner filed Divorce Case No. 257 of 2016 in the Court of Principal Judge, Family Court, Bhojpur at Ara, but in spite of that petitioner is still ready to keep the informant with
Patna High Court Cr.Misc. No.2071 of 2017 (2) dt.31-01-2017 2/2 full dignity, but she refused to live with the petitioner at the time of disposal of the Anticipatory Bail of the petitioner vide order dated 22.11.2016 passed in ABP No. 1855 of 2016 by the Sessions Judge, Rohtas.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the SDJM, Bikramganj Rohtas in connection with Complaint Case No. 274 of 2015, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
