JUSTICE JYOTI SARAN ORAL JUDGMENT Date: 30-09-2016 Mr. Raj Kumar, learned counsel for the petitioner and Mr. Vikas Ratan Bharti, A.C. to G.P.9 are present. Though the writ petition was filed questioning the order of suspension bearing Memo No. 788 dated 25.6.2014 impugned at Annexure-1 but on call of the matter Mr. Raj Kumar produces an order bearing Memo No. 1005 dated 14.12.2015 of the Executive Officer Nagar Parishad, Forbesganj whereunder the suspension order has been revoked thus redressing the grievance raised in the writ petition. The grievance which yet subsist according to Mr. Raj Kumar, is, that as no order has been passed for payment of pay and allowances for the suspension period and that the petitioner has only

Although Nagar Parishad, Forbesganj is served through Mr. R.K. Samrendra but there is no representation on their behalf on call. Having heard learned counsel for the parties and considering the stage at which the present matter rests I deem it fit to direct the Executive Officer Nagar Parishad, Forbesganj to consider the grievance of the petitioner as regarding payment of pay and allowance for the suspension period and dispose of the same in accordance with law within a period of six weeks from the date of receipt/production of a copy of this order.
Let the revocation order be maintained on records of the proceeding.
