JUSTICE SANJAY PRIYA ORAL ORDER 2/ 04-02-2017 Heard Mr. Ajay Kumar, learned counsel for the petitioner and the learned A.P.P. for the State. The Petitioner seeks bail in Complaint Case No.C63(7) of 2016 instituted under sections 47-A and 53-A of the Bihar Excise (Amendment) Act, 2016.

It is alleged that 500 ml. country made liquor and one plastic bottle was recovered from the possession of this petitioner. It is further alleged that the petitioner was found taking liquor, which was confirmed by breath analyzer test. The petitioner is in custody since 11.07.2016. It is mentioned in para 3 that the petitioner has no criminal antecedents.

Keeping in view the period of custody spent by the petitioner in custody, let the Petitioner, above named, be released

Patna High Court Cr.Misc. No.2255 of 2017 (2) dt.04-02-2017 2/2 on bail on furnishing bail bond of `10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Pradeep Kumar Chaudhary, Judicial Magistrate, 1st class, Udakishunganj, Madhepura, in connection with Complaint Case No.63(7) of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
