JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 19-01-2015 Despite repeated calls, nobody appeared on behalf of the petitioner to press this application. Counsel for the State is present.

The application has been filed for commanding the respondents to allow him to work on the post of Lecturer, Department of Botany, Masharakh College, Masharakh and to pay him salary/allowances.

The writ application was called out and considered on 09.01.2015 when the following order was passed:

Patna High Court CWJC No.19016 of 2010 (4) dt.19-01-2015 Nobody appears on behalf of the petitioner.

Counsel for the State and Mr. Mahtab Alam for the Bihar School Examination Board are present.

Counsels for the respondents have pointed out that from the pleadings on record, it would manifest that the petitioner claimed to have been functioning as Lecturer in a College which was privately managed. The grievance is precisely against the management of the said College.

Since, nobody has appeared on behalf of the petitioner, this Court would grant one more opportunity to the petitioner to argue the case on merit.

Post the application after 07 days in the same heading.

Since, nobody has appeared today, this Court is constrained to dismiss the application for non-prosecution. I order accordingly.
