The petitioner is apprehending her arrest in a case registered under Sections 341, 323, 326, 307, 302 and 498A/34 of the Indian Penal Code.
Allegation against the accused persons including the petitioner is of committing murder of the daughter of the informant by sprinkling Kerosene oil on her body. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. There is no eye witness to the alleged occurrence. The petitioner is separate in mess and property from the husband of the deceased.
Patna High Court Cr.Misc. No.49971 of 2017(2) dt.17-10-2017 2/2 The alleged occurrence is said to have taken place after eight years of marriage.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-6, Sitamarhi in connection with Bela P.S. case No.42 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
