Petitioners apprehend their arrest in Excise Case No.305 of 2018, registered under Sections 30(a) and 30(d) of the Bihar Prohibition and Excise Act.

Liquor and other articles kept for manufacturing liquor were recovered from a bush situated in the field and for that the petitioners were named on the allegation that the complainant got secret information about the fact that the petitioners were manufacturing liquor.

Learned counsel for the petitioners submits that there is nothing on record to show that the petitioner ever involved in

Patna High Court CR. MISC. No.54899 of 2019(2) dt.30-08-2019 2/2 any trade of illicit liquor. Petitioners have got no criminal antecedent.

Taking into consideration the facts aforesaid, let petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned IInd Additional Sessions Judge cum Special Judge, Excise, Samastipur in connection with Excise Case No.305 of 2018, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
