2. The petitioner seeks regular bail in a case registered for the offence punishable under sections Section 103 (1) and 3 (5) of BNS and 27 of Arms Act.

3 . As per the prosecution case , informant namely , Yugal Kishore Rai alleged that on 12.08.2024 , 3 unknown miscreants riding on motorcycle fired upon son of informant as a result of which he sustained firearms injury and thereafter he was taken to hospital where doctor declared him dead.

4. Learned counsel appearing for the petitioner submitted that petitioner is not named in the F.I.R. The name of the petitioner transpired during course of investigation in the

Patna High Court CR. MISC. No.57360 of 2025(2) dt.17-10-2025 2/2 confessional statement of other co-accused persons. Except confessional statement, there is no other material on record against this petitioner to show his complicity in the alleged occurrence . Petitioner is in custody since 26.11.2024 . 5 . Learned counsel for the State opposed the prayer for bail.

6. Considering the aforesaid facts of the case , case and counter case , period of custody and other circumstances of the case , prayer for regular bail of the petitioner is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM Vaishali at Hajipur in connection with Hajipur Sadar P. S. Case No. 567 of 2024 .
