JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341/323/308/379/504/34 of the Indian Penal Code. It is alleged that for a dispute with regard to making call on the mobile of wife of the neighbour Siwan Prasad all the five accused persons entered into the house of the informant and made assault to the informant, her mother-in-law and sister-in-law namely Kaili Devi and Sulekha Devi.

It is submitted by learned counsel for the petitioner that the accusation of assault is not specific against the petitioner and the injuries of Kaili Devi and Sulekha Devi have been found to be simple in nature. There is counter is counter version of the occurrence also and a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

No.1464 of 2016 (2) dt.12-01-2016 2/2 Considering the genesis of occurrence and the accusation being omnibus and general, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Hilsa, Nalanda in connection with Ekangarsarai P.S. Case No.185/2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
