2. The petitioner has prayed for bail in a case registered for the offence punishable under sections 419 and 420 of the Indian Penal Code and section 10 of Bihar Exam Act.

3. As per allegation in the FIR, petitioner was arrested on entrance gate while he was attempting to appear in competitive examination of MTS in place of another candidate.

4. It is submitted by learned counsel for the petitioner that petitioner has falsely been implicated in this case. Petitioner was only holding the admit card of his friend but the police has apprehended him showing him as he was attempting to appear in place of another candidate. Similarly situated other accused person has already been enlarged on bail by another coordinate

Patna High Court CR. MISC. No.62750 of 2023(2) dt.05-10-2023 2/2 Bench of this Court vide order dated 8.8.2023 passed in Cr. Misc. No. 49812 of 2023. Petitioner has got no criminal antecedent and languishing in judicial custody since 14.6.2023.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Danapur in connection with Rupaspur PS Case No. 437 of 2023.
