The petitioners being the brother and father of the husband of the victim are apprehending their arrest in a case registered for the offences punishable under Sections 302, 120B/34 of the Indian Penal Code and 3/4 of Dowry Prohibition Act.

The accusation is of killing the daughter of the informant after one of the marriage for non-fulfillment of the dowry demand.

It is submitted by learned counsel for the petitioners that even as per the FIR the informant is not the eye

Patna High Court Cr.Misc. No.53644 of 2015 (2) dt.26-11-2015 2/2 witness to the occurrence and the informant has not supported the accusation during the trial of co-accused Indrashan Devi. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Riga P.S. Case No. 77 of 2015 pending in the court of learned Chief Judicial Magistrate, Sitamarhi.

With the aforesaid observation, this application is disposed of.
