2. The petitioner has prayed for bail in a case registered for the offence punishable under sections 147, 149, 341, 323, 447, 448, 379, 354(B), 436, 427, 504, 506 of the Indian Penal Code.
3. Prosecution story relates to abuse and assault to the informant and his family members by the petitioner and other co-accused persons. It is further alleged that accused persons put the house of the informant on fire. In the background of the case, there is land dispute between the parties.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has been falsely implicated in this case. There is case and counter case
Patna High Court CR. MISC. No.63258 of 2023(2) dt.09-10-2023 2/2 between the parties. No one has received burn injury or any type of loss caused by fire. He has got no criminal antecedent and languishing in judicial custody since 22.6.2023.
5. Learned APP appearing for the State has opposed the prayer of Bail.
6 . Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned SDJM, Araria in connection with Raniganj P.S.
