Petitioners apprehend their arrest in a case registered for the offence punishable under Section 302, 120B, 34 of the Indian Penal Code and u/s 27 of Arms Act.

As per the prosecution case, co-accused, Anshu Yadav and his associates, including the petitioners, shot dead the husband of informant.

Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in the case due to land dispute between the parties. No such occurrence, in the manner, as alleged in the FIR, has ever taken

Patna High Court CR. MISC. No.69598 of 2021(2) dt.19-07-2022 2/2 place. Police after investigation submitted final form against the petitioners but learned court below differing with the final form took cognizance against this petitioners.

Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case and nature of accusation against the petitioners, let the petitioners, above named, in the event of their arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhepura in connection with Gamhariya PS case No.154/ 2020, subject to conditions laid down u/s 438(2) of the Cr. P. C.
