2. The petitioner has prayed for regular bail in a case instituted for the offence under Sections 341, 321, 448, 324, 325, 354B, 380, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act.
3. The allegation against the petitioner along with others is of assaulting the complainant and his family members
Patna High Court CR. MISC. No.65797 of 2023(2) dt.17-10-2023 2/3 by means of pistol butt due to which they sustained injury. It is further alleged that the accused persons took away jewellery, cloth and cash of Rs. 50,000/- from the house of the complainant.
4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case due to ulterior and oblique motive. He has committed no offence. Petitioner has made accused due to the dirty village politics and it also transpires from the Complainant itself that the story is concocted and with mala fide intention to bind the petitioner. He submitted that the date of occurrence was of 23.10.2020 at about 8:00AM and the complaint was filed on 11.11.202, and the reason for the delay, as stated that the police have not registered the FIR. He is languishing in judicial custody since 01.07.2023.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as period of custody, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the
