JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 30-01-2016 Heard learned counsel for the petitioner, learned APP for the State along with learned counsel for the informant. Petitioner along with Surendra Paswan have been alleged to have unsuccessfully attempted to commit rape upon the informant, Ranju Devi. Petitioner happens to be under custody since 05.09.2015. Furthermore, it is evident from the case diary, more particularly, from para-40 thereof, that the husband of informant and father of petitioner happens to be full brother and on account of dispute over partition, the instant case has been filed.

Accordingly, petitioner, Birendra Paswan is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Sri Jawed Alam, J.M. 1st Class, Muzaffarpur in connection with Siwaipatti PS Case No. 50/15.
