The slip for listing was filed pursuant to notice dated 08th May 2019, published prior to the vacation. Matter is, accordingly, taken up for consideration as both parties are present and willing to assist the Court for disposal of the matter.

Heard learned counsel for the petitioner and the respondent-State.

Petitioner's claim on account of first, second and third

Patna High Court CWJC No.22241 of 2018(2) dt.27-05-2019 2/2 benefits under Assured Career Progression Scheme as well as benefits on account of revision was made before respondent No 3 vide Annexure 3. It is submitted that copy of representation was also posted to respondent No 2. The postal receipt (Annexure 5/A) has been placed on record in the instant writ proceedings.

The short submission made by the petitioner's counsel is that the petitioner's claim, contained in Annexure 3/A, be disposed of by respondent No 2.

In view of the limited submission and since decision on the claims of the petitioner are to be taken by respondent No 2, this writ petition need not be kept pending. The same is disposed of.

Respondent No 2 is directed to take final decision within eight weeks from the date of receipt/production of a copy of this order.

If any dues are found admissible, payment should be ensured within four weeks thereafter.
