The petitioners apprehend their arrest in connection with Harnaut P.S. Case No. 275 of 2015 for offence punishable under Sections 302/34 of the Indian Penal Code. The petitioners happen to be the father-in-law and brother-in-law of the deceased. Allegation made in the FIR charges these petitioners along with husband of the deceased of assaulting the deceased.
Mr. Rakesh Kumar Shrivastava, learned counsel for the petitioners with reference to the FIR has submitted that as per the informant himself, the deceased informed him that the assault on the abdomen was made by the husband and in a general accusation these petitioners have been charged with the offence. With
Patna High Court Cr.Misc. No.52861 of 2015 (3) dt.14-12-2015 reference to the postmortem report taken note of in the order of the court below, he submits that it may be on account of the tuberculosis disease suffered by the deceased or the assault on the stomach, which may have led to the unfortunate incident. Having heard learned counsel for the parties and considering the circumstances discussed, let the petitioners, namely, (1) Balram Bind; and (2) Ramuchit Bind in the event of their arrest or surrender within four weeks from today be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, Nalanda at Bihar Sharif and/or the court concerned in connection with Harnaut P.S. Case No. 275 of 2015 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
