JUSTICE ARVIND SRIVASTAVA ORAL ORDER 24-11-2017 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Jehanabad Police Station Case No. 510 of 2017, disclosing offences under Sections 175, 420 and 409 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. As a matter of fact, the petitioner happened to be clerk in Jehanabad Circle Office and has been relieved from there to join Kako Circle office on 13.07.2016. The petitioner was not responsible for depositing of any records as he was not the custodian of said records. Moreover, the

No.51828 of 2017 (3) dt.24-11-2017 records, which are said to be missing and for that the petitioner has falsely been implicated, were received on 27.07.2016 and 04.08.2016 by one Senior Clerk Amrendra Kumar, which is evident from annexure-3 series. Hence, the petitioners who are of clean antecedent deserves the privilege of anticipatory bail. Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad, in connection with Jehanabad Police Station Case No. 510 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
