The petitioner is in custody since 31.03.2019 in connection with Salkhua (Banma Ithari O.P.) P.S. Case No. 53 of 2019, registered for the offence, punishable under Section 302/34 of the Indian Penal Code.

Having perused the FIR, it appears that the name of the petitioner has not been taken by the son of the deceased, who is said to be eye-witness to the occurrence and the petitioner has falsely been implicated in this case on mere suspicion.

Considering the aforementioned facts and circumstances, let the petitioner above named be released on

Patna High Court CR. MISC.
