JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-11-2017 By way of the present application, petitioner seeks modification of the order dated 03.03.2017 passed in Cr. Misc. No. 8800 of 2017 vide which petitioner was directed to surrender before the court below along with demand draft of Rs. 3,00,000/- and on that event he was directed to be released on provisional bail with direction to pay rest amount in three months. Submission of learned counsel for the petitioner that he has now paid all the amounts but not within the time stipulated by the court rather he has paid the whole amount in seven months and further it has also been submitted that petitioner has uptil now not surrendered in the court below. In view of the above, let petitioner fist surrender

Patna High Court Cr.Misc. No.49918 of 2017 (2) dt.08-11-2017 2/2 before the court below within a period of four weeks and if he does so, the court below after being satisfied with the deposited amount, shall release the petitioner on bail otherwise he is free to pass any order or orders as he deems fit and proper. With the above observation, this modification application is disposed of.
