ANJANA MISHRA ORAL ORDER 05-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 29.07.2019 in connection with Madhepura (Parmanandpur O.P.) P.S. Case No.652 of 2019 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the alleged recoveries were made from the ditch near the bamboo clump and not from the conscious possession of the petitioner. So far as the criminal antecedent of the petitioner, which has been stated in paragraph 3 of the petition, is concerned, learned counsel submits that the entire case is false and fabricated and has been instituted on the instigation of his enemies.

P.S. Case No.652 of 2019.
