JUSTICE SANJAY PRIYA ORAL ORDER 11-01-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in Motipur P.S. Case No. 205 of 2014 instituted for the offence under Sections-342, 323, 376/34 of the Indian Penal Code.

As per written report, there is specific allegation against this petitioner of kidnapping the informant and committing rape with her. The victim girl has given statement u/S 164 Cr.P.C. wherein also she has levelled specific allegation against this petitioner. The case diary has been received and after perusing the case diary, learned APP has submitted that from para-104 of the case diary, it appears that the processes u/Ss 82 & 83 has already been issued against the petitioner.

Therefore, this court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail is rejected. The petitioner is directed to surrender in the court below and seek regular bail which will be considered and disposed of on its
