The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 448, 354(A), 326(A), 307 of the Indian Penal Code.

The prosecution case as per F.I.R is that when the informant was sitting at her door, all the F.I.R named accused persons including the petitioner came and told that her son Niraj Mandal has taken their daughter Sunita after manipulating her when the informant opposed and stated that her son is at home. It

No.69818 of 2021(5) dt.26-09-2022 2/3 is further alleged that when husband of the informant came out, the accused persons threw acid upon her husband due to which both hands and legs of her husband got burnt. It is alleged against the petitioner that he outraged the modesty of the informant. It is submitted by learned counsel for the petitioner that petitioner has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. It is further submitted that sister of the petitioner was raped by the son of the informant for which Budhuchak P.S. Case No. 16 of 2021 was registered. Hence, as a retaliatory measure, the present false case has been lodged against the petitioner. The injury report of the husband of the informant suggests the injuries to be simple in nature. A statement has been made in para 3 of the petition that petitioner is accused in one other case apart from the present one.
