====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 25-02-2022 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks regular bail in connection with Nathnagar (Lalmatiya) P.S. Case No. 536 of 2021 registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner is in custody since 05.10.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case.

Allegation is of recovery of 72.75 liters of liquor from the house of the petitioner.

No.69323 of 2021(2) dt.25-02-2022 2/2 Learned counsel for the petitioner submits that the petitioner has been falsely implicated and further the house is a joint family property and as such, he was not knowing who had kept the liquor in the house. Learned APP for the State opposes the bail application.

Considering the fact that the petitioner is in custody since 05.10.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case the petitioner above-named is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 2,000/- (two thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge -II -cum- Special Judge (Excise Act), Bhagalpur in connection with Nathnagar (Lalmatiya) P. S. Case No. 536 of 2021.

The application is stands allowed.
