JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 10-08-2018 This writ application was preferred in the year 2015 for quashing of the first information report being Amnour P. S. Case No. 65 of 2017 registered under the various provisions of the Indian Penal Code.
On instruction learned counsel representing the petitioner submits that during the pendency of the writ application now the investigation has been completed and a charge-sheet has been filed in the court below. Learned counsel submits that since a charge-sheet has already been submitted in the court below, in case the court below takes cognizance and decides to issue summons to the petitioner, he may be given liberty to move afresh before this Court under the Code of Criminal

In view of the submission made on behalf of the petitioner, this writ application is disposed of with liberty to the petitioner to seek his remedy in accordance with law, in case he is summoned by the court below after taking cognizance.
